Terms of Service — Section 1: Acceptance & Service Identity
1. Acceptance of these Terms
These Terms of Service (“Terms”) govern your access to and use of the KnowledgeSet website and learning platform (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
If you are using the Service on behalf of a child, you confirm that you are the child’s parent or legal guardian (or otherwise authorised to act on their behalf) and that you accept these Terms on the child’s behalf.
2. Who We Are
The Service is operated by KNOWLEDGESET LTD (“KnowledgeSet”, “we”, “us”, “our”).
3. Governing Law
These Terms are governed by the laws of England and Wales. Where disputes cannot be resolved informally, the courts of England and Wales will have jurisdiction, subject to any mandatory rights you may have under applicable law.
Terms of Service — Section 2: Who May Use the Service
1. Intended Users
KnowledgeSet is an educational service intended for students aged 6 to 18 and their parents or guardians. Accounts may be created either by a parent/guardian on behalf of a student or directly by a student.
2. Children and Parental Responsibility
If a student is under the age of 13, a parent or legal guardian must provide consent for the student to use the Service and for the creation of an account. By creating an account for a child, or by permitting a child to use the Service, the parent/guardian confirms that they consent and accept responsibility for the child’s use of the Service.
We do not currently operate a formal age-verification process. For younger users, we assume parental oversight and encourage parents/guardians to supervise a child’s use of the Service where appropriate.
3. Eligibility and Compliance
You may use the Service only if you can form a legally binding agreement with us (or, where applicable, if your parent/guardian accepts these Terms on your behalf) and you will comply with these Terms and all applicable laws.
Terms of Service — Section 3: Accounts & User Responsibilities
1. Account Information
When creating an account, you agree to provide information that is accurate and up to date. You are responsible for maintaining the accuracy of your account details.
2. Account Security
You are responsible for keeping your login details confidential and for all activity that occurs under your account. If you believe your account has been compromised or used without your permission, you must notify us as soon as possible.
3. Account Sharing
Your account is for your personal use (or, where a parent/guardian creates an account for a child, for that child’s use). You must not share, sell, or transfer your account credentials to others or allow unauthorised access to the Service.
4. Misuse and Suspension
We may suspend, restrict, or terminate access to the Service if we reasonably believe you have breached these Terms, misused the Service, or created a risk to other users, the platform, or our rights.
Terms of Service — Section 4: Acceptable Use
1. Acceptable Use Rules
You must use the Service lawfully and responsibly. You agree not to misuse the Service or help anyone else to do so.
2. Prohibited Activities
In particular, you must not:
- Use the Service for any unlawful purpose or in a way that violates any applicable laws or regulations
- Harass, abuse, threaten, or harm other users, or encourage others to do so
- Attempt to gain unauthorised access to the Service, user accounts, or underlying systems, or attempt to hack, disrupt, overload, or interfere with the Service
- Scrape, copy, download, reproduce, distribute, or otherwise exploit any content from the Service except as permitted for normal personal use within the platform
- Reverse engineer, decompile, disassemble, bypass, or attempt to circumvent any security, access controls, or technical measures used to protect the Service or its content
3. Enforcement
We may investigate suspected misuse and may suspend or terminate access to the Service where we reasonably believe a breach of these Terms has occurred.
Terms of Service — Section 5: Educational Disclaimer
KnowledgeSet is an educational support platform designed to help students study and practise. The Service is provided for informational and educational purposes only.
While we aim to provide high-quality learning materials and tools, we do not guarantee any specific outcomes, including particular grades, exam results, or academic performance. Progress and results depend on many factors outside our control, such as individual study habits, curriculum changes, exam conditions, and teaching received elsewhere.
KnowledgeSet does not replace formal schooling, teaching, tutoring, or professional educational advice. You are responsible for how you use the Service and for verifying that the learning approach and content are appropriate for your needs.
Terms of Service — Section 6: Subscriptions, Payments & Refunds
1. Subscriptions and Paid Features
Some parts of the Service may be offered on a paid subscription basis. Where a subscription is required, you must have an active subscription to access the relevant paid features and content.
2. Payments
Subscription payments are processed securely by a third-party payment processor. We do not store full payment card details on our servers. You agree to provide valid payment information and authorise us (via our payment processor) to charge the applicable subscription fees, including any recurring charges associated with your plan, until your subscription is cancelled.
3. Pricing and Changes
Prices, plans, and included features may change from time to time. If changes apply to an existing subscription, we will take reasonable steps to communicate material changes in advance where appropriate.
4. Refunds
We do not offer a general right to refunds unless required by applicable law. Where you believe you are entitled to a refund under applicable law, you can contact us at support@knowledgeset.co.uk with details of your request.
Terms of Service — Section 7: Intellectual Property
1. Our Intellectual Property
The Service, including the website, platform, software, design, text, questions, videos, lesson materials, trademarks, logos, and all other content and materials made available through KnowledgeSet (together, the “Content”), is owned by or licensed to KNOWLEDGESET LTD and is protected by intellectual property laws.
2. Limited Licence to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service and Content for your personal educational use (or, where a parent/guardian creates an account for a child, for that child’s educational use) during the term of your access.
3. Restrictions
You must not, except where permitted by law:
- Copy, reproduce, modify, distribute, publish, transmit, upload, display, sell, licence, or otherwise exploit any part of the Service or Content
- Share, resell, or redistribute Content (including by sharing accounts, downloading and re-uploading materials, or posting Content publicly)
- Use the Service or Content to create competing products or services, or to train or improve third-party systems, except as permitted by law or with our prior written consent
All rights not expressly granted to you are reserved by KnowledgeSet.
Terms of Service — Section 8: Service Availability & Changes
1. Availability
We aim to provide a reliable Service, but we do not guarantee that the Service will be available at all times or without interruption. From time to time, the Service may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our reasonable control.
2. Changes to the Service
We may modify, update, add to, or remove features, content, or functionality of the Service at any time. This includes improving existing features, introducing new features, and changing how parts of the Service operate.
3. Suspension or Discontinuation
We may suspend the Service (or any part of it) temporarily for maintenance or operational reasons. We may also discontinue parts of the Service or, in rare cases, discontinue the Service entirely. Where reasonable and appropriate, we will take steps to provide notice of material changes or discontinuation through the Service or by email.
Terms of Service — Section 9: Termination
1. Termination by You
You may stop using the Service at any time. You may also delete your account through the Service (where available).
2. Suspension or Termination by Us
We may suspend, restrict, or terminate your access to the Service (and/or terminate your account) if we reasonably believe that:
- you have breached these Terms,
- you have misused the Service, or
- your use creates a risk to other users, the Service, or our rights.
3. Effect of Termination
If your account is terminated or you stop using the Service, your right to access the Service and Content will end. Some provisions of these Terms will continue to apply after termination, including (where applicable) provisions relating to intellectual property, disclaimers, limitation of liability, and governing law.
Terms of Service — Section 10: Liability & Responsibility
1. Service Provided “As Is”
To the extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.
2. Limitation of Liability
To the fullest extent permitted by applicable law, KnowledgeSet will not be liable for any indirect, incidental, special, consequential, or punitive losses or damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Service.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
3. Events Outside Our Control
We will not be responsible for any failure or delay in performance of the Service that results from events outside our reasonable control (including internet or hosting failures, third-party service interruptions, or other force majeure events).
Terms of Service — Section 11: Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, legal requirements, or how we operate the platform.
When we make updates, we will post the updated Terms on our website. Where changes are material, we will take reasonable steps to notify users through the Service or by email, where appropriate. Continued use of the Service after updated Terms take effect means you agree to the updated Terms.
